Jardin View Landscapes SMS Terms of Service

1. Description of the Service

The Service allows Jardin View Landscapes to send and receive SMS and text messages relating to our business relationship with you.

Messages may include: responses to customer questions and inquiries; estimate notifications and estimate follow-ups; appointment and service confirmations; scheduling and rescheduling notifications; service reminders; arrival notifications; landscaping project updates; weather-related delays or schedule changes; requests for information needed to complete a service; invoice and billing notifications; customer support communications; and other messages reasonably related to landscaping services you requested or receive from us.

The Service is intended primarily for customer care, service coordination, scheduling, and other communications related to your relationship with Jardin View Landscapes.

2. How to Opt In

You may opt in to receive SMS messages from Jardin View Landscapes through one or more of the following methods: entering your mobile telephone number on an online form that includes an SMS consent disclosure; requesting an estimate or landscaping service and affirmatively agreeing to receive SMS communications; completing a written or electronic form containing your mobile telephone number and an SMS consent disclosure; providing documented consent during an in-person or telephone interaction; texting an advertised keyword, such as START, when that option is available; or initiating a text message conversation with Jardin View Landscapes.

Providing your telephone number does not automatically authorize every category of SMS communication. Jardin View Landscapes will use your number in a manner consistent with the consent you provided and the circumstances in which it was collected.

3. Consent to Receive Messages

By affirmatively opting in to the Service, you authorize Jardin View Landscapes and its communications service providers to send text messages to the mobile telephone number you provided.

Your consent applies to messages reasonably related to your inquiry, estimate, appointment, scheduled work, active landscaping project, customer account, invoice, or other business relationship with Jardin View Landscapes.

Consent to receive SMS messages is not a condition of purchasing goods or services from Jardin View Landscapes.

You represent that: you are the subscriber or customary user of the mobile telephone number provided; you are authorized to consent to receiving messages at that number; the information you submitted when opting in is accurate; and you will notify us if you stop using or controlling that mobile telephone number.

4. Message Frequency

Message frequency varies based on the services you request, your scheduled or active landscaping work, weather conditions, project changes, your questions or responses, and the frequency with which you communicate with us.

Some customers may receive multiple messages during scheduling or while a project is active. Other customers may receive messages less frequently.

Jardin View Landscapes does not guarantee a specific number of messages.

5. Message and Data Rates

Message and data rates may apply to messages sent to or received from Jardin View Landscapes.

Any charges associated with SMS messages are determined by your mobile service provider and your wireless plan. Jardin View Landscapes is not responsible for message, data, roaming, or other charges imposed by your mobile carrier.

Contact your mobile service provider if you have questions about your wireless plan or applicable charges.

6. How to Opt Out

You may opt out of receiving SMS messages from Jardin View Landscapes at any time by replying STOP.

After submitting an opt-out request, you may receive one final confirmation message stating that you have been unsubscribed. You will not receive additional messages through the applicable SMS program unless you opt in again.

Where supported, we may also recognize customary opt-out keywords such as CANCEL, END, QUIT, and UNSUBSCRIBE. The most reliable way to opt out is to reply STOP.

If you have opted out and later want to receive SMS messages again, you may reply START where supported or complete a new opt-in process.

Your opt-out request applies to SMS messages. It does not prevent Jardin View Landscapes from contacting you through another permissible communication method when necessary to address an active service, safety issue, customer support matter, invoice, contractual obligation, or legal requirement.

7. Help and Customer Support

For assistance with the Service, reply HELP.

You may also contact Jardin View Landscapes using the information provided in Section 19 of these Terms.

A HELP response may provide our business telephone number, email address, or other instructions for obtaining assistance.

8. Supported Carriers and Devices

The Service may not be available through every mobile carrier, device, telephone number type, or service plan.

Your ability to receive or respond to messages depends on your mobile device, your wireless service plan, your mobile carrier, network availability, device settings, whether your telephone number supports SMS messaging, and services operated by third-party communications providers.

You are responsible for maintaining a device and wireless plan capable of sending and receiving SMS messages.

9. Message Delivery

SMS message delivery is subject to effective transmission by mobile carriers, communications providers, networks, devices, and other systems outside the direct control of Jardin View Landscapes.

Messages may be delayed, blocked, filtered, duplicated, misdirected, or undelivered due to circumstances such as network congestion, carrier filtering, service outages, device settings, an inactive or disconnected telephone number, changes to your wireless service, technical problems, or events outside our reasonable control.

Jardin View Landscapes, its communications providers, and participating mobile carriers do not guarantee that messages will be delivered or received within a particular period. Mobile carriers are not liable for delayed or undelivered messages.

Do not rely solely on SMS for urgent, emergency, safety-critical, or time-sensitive communications.

10. Your Responsibilities

When using the Service, you agree to: provide accurate contact information; use only a mobile telephone number you control or are authorized to use; notify Jardin View Landscapes if your telephone number changes; avoid sending unlawful, abusive, threatening, defamatory, fraudulent, or harmful content; avoid interfering with the operation or security of the Service; avoid using the Service to transmit malware, malicious links, or unauthorized advertisements; avoid impersonating another person or misrepresenting your identity; and comply with applicable laws and regulations.

You are responsible for messages sent from your device or telephone number unless you have notified Jardin View Landscapes that the device or number is no longer under your control.

11. Changes to Your Telephone Number

If you discontinue, transfer, or change the mobile telephone number that you used to opt in, you agree to opt out before relinquishing the number or promptly notify Jardin View Landscapes.

This helps prevent messages intended for you from being delivered to another person who later receives the number.

12. Privacy and Use of Information

Our collection, use, protection, retention, and disclosure of Personal Information associated with the Service are described in our SMS Privacy Policy.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent information will not be shared with any third parties, except as necessary to provide and operate the Service or as required by law.

Information may be processed by communications providers, mobile carriers, hosting providers, and other vendors when necessary to deliver messages, maintain consent records, honor opt-out requests, provide customer support, protect the Service, or comply with applicable law.

13. Third-Party Service Providers

Jardin View Landscapes may use third-party communications providers, including Net2Phone or its messaging partners, to provide and manage the Service.

These providers may process mobile telephone numbers, message content, message delivery information, opt-in and consent records, opt-out requests, help requests, and other technical information necessary to provide the Service.

Third-party providers and mobile carriers do not control the landscaping services, estimates, scheduling, billing, project decisions, or customer service provided by Jardin View Landscapes.

To the extent permitted by law, those providers are not responsible for disputes between you and Jardin View Landscapes concerning our business services.

14. Sensitive and Confidential Information

SMS is not guaranteed to be a secure form of communication.

Do not send highly sensitive or confidential information through the Service, including Social Security numbers, passwords, financial account credentials, complete payment card information, medical information, government identification numbers, or other information that could create a significant risk if accessed by another person.

If payment information is needed, Jardin View Landscapes may direct you to a more appropriate payment or communication method.

15. Photographs and Other Content

You may choose to send photographs, documents, descriptions, or other content through the Service when communicating about a property, estimate, landscaping concern, or scheduled service.

By sending content to Jardin View Landscapes, you represent that: you have the right to provide the content; the content does not violate another person's privacy or legal rights; and Jardin View Landscapes may use the content as reasonably necessary to respond to your inquiry or provide the requested services.

Sending content through SMS does not transfer ownership of that content to Jardin View Landscapes.

16. Availability and Modification of the Service

Jardin View Landscapes may modify, suspend, restrict, or discontinue all or part of the Service when reasonably necessary.

We may also change the communications provider used to deliver messages, the telephone number or short code from which messages are sent, the types of operational messages available, the methods through which customers may opt in, or the features or functionality of the Service.

We do not guarantee that the Service will always be available, uninterrupted, or error-free.

17. Disclaimer and Limitation of Liability

The Service is provided on an "as available" basis to the extent permitted by applicable law.

Jardin View Landscapes does not guarantee continuous availability of SMS messaging, delivery of every message, delivery within a particular period, compatibility with every carrier or device, or that messages will be free from interception, delay, filtering, or technical error.

To the extent permitted by applicable law, Jardin View Landscapes will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.

Nothing in these Terms excludes or limits any responsibility that cannot lawfully be excluded or limited.

18. Changes to These Terms

We may update these Terms to reflect changes to the Service, our business practices, carrier or communications provider requirements, applicable laws and regulations, our Privacy Policy, or available messaging features.

The revised Terms will be posted with an updated "Last updated" date.

Unless otherwise required by law, changes become effective when posted. Your continued participation in the Service after updated Terms are posted constitutes acceptance of the revised Terms.

If a material change requires additional consent under applicable law, Jardin View Landscapes will obtain that consent before applying the change as required.

20. Entire SMS Agreement

These Terms and the Jardin View Landscapes SMS Privacy Policy constitute the agreement governing participation in the Service.

If another customer agreement applies to landscaping or related services, that agreement continues to govern those services. These Terms govern only the SMS messaging component of the relationship.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

22. No Waiver

A failure by Jardin View Landscapes to enforce a provision of these Terms does not waive our right to enforce that provision later.
